Terms of Service

Modacast is operated by Railex Technology OÜ, an Estonian company. By creating an account, accepting an invitation or using Modacast, you agree to these terms and the Privacy Notice. If you act for an organisation, you confirm that you have authority to bind it.

You must be at least 18 years old and legally able to enter this agreement. Modacast does not permit profiles, accounts, invitations or uploaded information relating to minors. Agencies are responsible for verifying age before adding a person.

Sign-in uses supported OAuth providers. You must provide accurate information, keep your provider account secure, use only your own access and notify us promptly of suspected compromise. Workspace owners control invitations and roles and are responsible for promptly removing access that is no longer authorised.

• Have a lawful basis, authority and any required notices for personal data entered or shared through Modacast.
• Have authority to represent each model and comply with employment, talent-agency, immigration, sanctions, anti-trafficking and market-specific rules.
• Keep calendars, availability, representation and contact information accurate enough for their intended professional use.
• Use recipient access and public or private sharing links carefully and revoke or archive material when access should end.
• Respond to clients, models, partner agencies and data-subject requests for matters under the agency's control.

You may use Modacast only for lawful professional talent and agency operations.

• Do not exploit, coerce, harass, discriminate against or misrepresent any person.
• Do not upload unlawful, deceptive, infringing, malicious or unauthorised content.
• Do not scrape, resell, reverse engineer, probe, overload or bypass access controls or tenant boundaries.
• Do not share credentials or use contact data for spam, advertising lists or unrelated solicitation.
• Do not use Modacast to facilitate prohibited jurisdictions, sanctioned parties, illegal work or unlawful recruitment fees.

Modacast provides calendars, portfolios, availability and workflow records. It is not a party to any representation, employment, booking or placement agreement and does not verify or guarantee a model, agency, client, opportunity, availability or outcome.

No client, model or agency payment for talent work moves through Modacast. Any commercial arrangement is made and settled off-platform by the relevant parties. Stripe processes only an agency's own Modacast subscription; it does not process talent fees, booking payments or commissions.

You retain ownership of content you provide. You grant Railex a limited, non-exclusive licence to host, copy, display, transmit and technically process that content only as needed to operate, secure and support Modacast. You confirm that you have the rights and permissions required for the content and the sharing choices you make.

Modacast's software, design, brand and documentation belong to Railex or its licensors. Subject to these terms, we grant you a limited, revocable, non-transferable right to use the service for its intended business purpose. No other rights are granted.

We aim to provide a reliable service but do not promise uninterrupted or error-free availability. We may maintain, change or discontinue features for security, legal, technical or product reasons. We will try to give reasonable notice of material changes where practical.

We may restrict or suspend access where reasonably necessary to protect people or the service, investigate misuse, comply with law, address non-payment of a future agency subscription, or enforce these terms. You may stop using the service and request account closure. Provisions intended to survive termination continue to apply.

The service is provided on an as-available basis to the extent permitted by law. Railex does not provide legal, employment, immigration, safeguarding or financial advice. Nothing in these terms excludes liability that cannot legally be excluded. Any limitation of liability must be interpreted under mandatory consumer and commercial law and requires final review by Estonian counsel.

These terms are governed by Estonian law, without overriding mandatory protections that apply to you. Before starting formal proceedings, contact us so we can try to resolve the issue. The competent Estonian courts will have jurisdiction unless mandatory law requires another forum.

We may update these terms for legal, security or service changes. The updated date will appear above, and material changes will receive reasonable notice. Contact info@modacast.co for legal or privacy enquiries until a separate legal contact is published.
